On March 16, 2016, Free Access & Broadcast Telemedia LLC (“FAB”) filed a reply brief with the US Court of Appeals for the District of Columbia Circuit regarding its motion to stay the spectrum incentive auction pending judicial review.
The FCC’s reply brief to FAB’s opening motion was filed yesterday. FAB has respectfully requested a decision by March 28 on the stay motion, the day before the FCC wishes to begin the reverse auction process. Oral arguments in the ongoing appeal are scheduled for May 5, 2016.
The existential rights of low power television stakeholders nationwide must not be cast aside by the FCC’s race to lower the auction gavel, in direct conflict with the ironclad rights of those seeking orderly judicial review.
